Anticipatory methodology for investigating crimes committed using digital technologies: features, development trends

The difficulty in investigating crimes committed using digital technologies is that these technologies are constantly evolving. Due to this, the criminals are constantly improving the method and mechanism of committing specific crimes, which creates serious difficulties for investigation. From time to time, investigators have to deal with crimes that, by their method and mechanism of commission, have no analogues among those previously committed. Because of this, the effectiveness in establishing the circumstances of the committing crimes decreases. In some cases, this allows criminals to conceal a crime or give the opportunity for the perpetrators to escape detection. This leads to the need for investigative authorities to use a technique capable of offering such criminalistic recommendations that, looking into the future, could offer the most optimal solution, i.e., there is an obvious need to create an anticipatory forensic technique. The purpose of the study is to identify the features of anticipatory methods for investigating crimes committed using digital technologies and trends in the development of these crimes, which should be taken into account when formulating forensic recommendations. Materials and methods. In addition to general scientific methods, special methods developed in criminology were used during the research. Thus, methods of modeling criminalistic situations, system-activity and criminalistic forecasting were used. The study summarized the experience of investigating crimes committed using digital technologies. Results. Existing methods of investigating crimes committed using digital technologies do not provide investigators with recommendations for solving problems resulting from the use of new digital products by the criminals. This can contribute to deadlocks formation in establishing the circumstances of committing relevant criminal acts. With this in mind, investigators need a criminalistic technique that would avoid unpleasant surprises in cases where the latest digital technologies are used in committing crimes. Conclusions. Currently, due to development of scientific and technological progress and the desire of individual unlawfully minded individuals to use its results to achieve criminal goals, law enforcement agencies have faced a need to create an appropriate anticipatory forensic methodology that includes prognostically oriented recommendations, that is, recommendations for solving problems that the investigation has not yet encountered, but may face in the future.
