Implementation of immunity of residence principle in investigatory examination proceeding

The article considers relevant in modern criminal judicial proceedings in Russia problems connected with implementation of residence immunity constitutional principle when performing investigatory examination in a criminal case. In particular, the authors analyze executing crime scene examination in a dwelling at the initial stage of a criminal proceeding. Thus, the indicated investigative action is considered and presented in a dynamic context (i.e, not only basing on statutory wording, but with regard to implementation in investigative and judicial practice). Based on critical analysis of criminal procedure law currently in force and common investigative and judicial practices, action-oriented proposals and recommendations for improving and executing investigative inspection in a dwelling are drafted. The proposed approaches can be successfully applied by investigating and interrogating officers, other participants in criminal proceedings in order to optimize and improve the efficiency of proof as well as in the process of further improvement of existing criminal procedure legislation of the Russian Federation.
