To the Question of Forms, Methods, and Directions of the Theory of Legal Convergence

The relevance of the topic is due to the need to develop a verified formal-logical methodological apparatus of the theory of legal convergence, taking into account the introduction of new methods and approaches to the subject of research. The purpose of the study is to analyze the conceptual apparatus of the theory of legal convergence and identify the features of the author’s approaches to the study of the topic and promising directions for its study in domestic jurisprudence. Materials and methods. The implementation of the research goal was achieved using general scientific methods (analysis, synthesis), as well as the method of comparative theoretical analysis. An analysis of theoretical provisions and directions of legal convergence in the works of Russian and foreign researchers was carried out. Findings. The convergence of law is a well-established topic in the academic discipline known as comparative law. To analyze analogies and differences between systems of law, comparative lawyers have developed a number of tools, among which convergence is very important. It is noted that through the prism of legal convergence, the mechanism of convergence of national legal systems with each other and with international law is revealed today. Attention is drawn to the content of the directions of development of legal convergence at various levels, as well as to the problem of determining the forms and methods of researching legal processes and phenomena. Conclusions. Based on the study of the author's approaches to the theory of legal convergence, a promising direction for choosing an object and subject of research is determined – the study of institutional traditions of legal interaction in order to identify the most effective mechanisms of convergence and experience of the non-institutional phenomenon of legal interaction of the BRICS regional organization.
