The Object of the Abuse of Authority by a Private Detective or an Employee of a Private Security Organization

Despite the fact, that the generic object of the crime under Article 203 of the Criminal Code of the Russian Federation is public relations in the economic sphere, and the specific object is interests of service in commercial and other organizations, as enshrined in the name of Chapter 23 of the Criminal Code, the direct object of the crime is characterized ambiguously. The purpose of the study is to identify the specific characteristics of the object of a criminal act, enshrined in Article 203 of the Criminal Code of the Russian Federation, which establishes criminal liability for abuse of authority by private detectives and employees of private security organizations. Materials and methods. A formal logical method was used as a key methodological approach in the study, which made it possible to correlate the norms of legislation with their theoretical interpretation by different scientists. Through a dialectical approach, several theoretical approaches were compared to the interpretation of the object of crime in the general criminal law dimension, as well as in relation to the allocation of generic and specific objects of abuse of authority by private detectives and employees of private security organizations. In addition, the author used discursive, textual, intersectoral and institutional methods of scientific cognition. Results. Based on the classical criminal law understanding of the object of the crime, liability is provided for in Article 203 of the Criminal Code of the Russian Federation. Two types of public relations should be noted. They are the relations developing in the course of providing services by a private detective and a private security organization and relations having a general legal (constitutional-legal) nature. Conclusions. The structuring of the object of the corpus delicti defined in Article 203 of the Criminal Code of the Russian Federation affects the qualification of these criminal acts and depends on the rule of law in the field of public relations, developing in the field of providing services by private detectives and private security organizations and regulated by various sources of law.
