On the issue of classifying the types of legal voting

Legal voting is a complex legal phenomenon that plays a key role in the legal regulation system as a decision-making mechanism with legally significant consequences. Its variety of forms and procedures, resulting from versatility of public relations regulated by the law, emphasizes the need for a systematic analysis and streamlining the knowledge about this phenomenon. The relevance of the research is due to immaturity of general theoretical approaches to the classification of legal voting, which makes it difficult to understand its essence and place in the legal system. This is especially important in the context of the dynamic development of legal institutions, where legal voting acts as a tool for realizing the rights of citizens and organizations, as well as ensuring the law and the order. The present study considers legal voting as a general theoretical phenomenon that goes beyond the framework of a single legal system. The purpose of the research is to systematize the types of legal voting, identify their essential features and develop their classification model. Materials and methods. The research is based on a wide range of sources, including scientific papers on classification theory. When conducting the classification, the norms of the current legislation of the Russian Federation were used to illustrate the distinguished classes. General scientific methods were applied: analysis to study classification definitions, synthesis to form the author's approach, systematization to organize types of voting, comparison to identify their features, as well as a special legal method of interpreting regulations. Results. Classification is recognized as a key method for organizing knowledge about legal voting. The existing definitions of classification are analyzed, their disadvantages are revealed: lack of consideration of purposefulness, differentiation of signs and bases, dynamism. The author's definition of classification is proposed. Four classification grounds are identified: the parties, the subject of voting, the voting procedure, and the legal consequences. Interrelation of voting types that form the legal mechanism of the society was established, which emphasizes their systemic nature and importance for the law and order. Conclusions. The types of legal voting are systematized and their key features are identified, which made it possible to deepen the theoretical understanding of this legal institution and its role in regulating public relations. Its scientific significance is reflected in clarifying the place of legal voting in the legal system. The practical significance lies in the possibility of using the results to improve law enforcement practices, develop recommendations for optimizing legislation and improve the effectiveness of voting procedures.
